The Texas Code of Criminal Procedure, Art 45.051(q) states — You may be able to require that a Houston Municipal Court or Harris County Justice of the Peace Precinct, JP Court moving traffic violation charge be dismissed by successfully completing a driving safety course or a motorcycle operator training course. You will lose that right if before your appearance date you do not provide the Court with notice of your request to take the course.
ELIGIBILITY:
You are eligible to take Driving Safety Course if the following DO NOT apply to you:
- You hold a Commercial Driver’s License (CDL);
- You have taken a Court-ordered DSC for another ticket within one year from the date of this citation;
- You are charged with:
- 95 miles per hour or more;
- Speeding 25 miles per hour or more over the posted speed limit;
- Passing a school bus;
- Committing a serious traffic violation;
- Failing to stop and provide information or render aid after an accident;
- Committing an offense in a construction zone when workers are present;
- You do not have a valid Texas Drivers License
Houston, TEXAS, Harris County JP COURT TRAFFIC CHARGES:
All moving violations except as mentioned above are eligible for a driving safety course dismissal, providing you have not taken A defensive driving course within the past 12 months to dismiss a traffic ticket.
DRIVING SAFETY (DEFENSIVE DRIVING) CLASS COST:
In Houston, each city municipal court and Harris County precinct justice of the peace or JP court has an application process which must be completed prior to enrolling in a driving safety class or taking a defensive driving course online.
Each court also charges a preset fee, which must be paid to the court.
You will also need a certified copy of your Texas DPS Driving Record Type 3A which is available at the time you register to take the driving safety course online.

Drivers Under the Age of 25
Texas drivers under the age of 25 years must take A defensive driving course regardless if they choose deferred disposition or deferred adjudication for a moving traffic violation.
